# Terms and Conditions of Sale

These Terms and Conditions of Sale ("Terms") govern the sale of products on this website (the "Site") by **RM ECOM**, trading as **Novell Home** ("we", "us", "our"), to you, the customer ("you"). By placing an order, you accept these Terms in full. Please read them before ordering. These Terms do not affect your mandatory statutory rights as a consumer.

## 2. Products
- We take care to describe and display our products accurately. Photographs and descriptions are provided for illustration; minor variations in colour or appearance may occur.
- Products are offered subject to availability. If a product becomes unavailable after you order, we will inform you and refund any amount already paid.
## 3. Prices
- Prices are displayed on the Site in **pounds sterling (GBP)** and include applicable taxes for UK orders, unless stated otherwise.
- Delivery costs, where applicable, are shown separately at checkout before you confirm your order.
- We reserve the right to change prices at any time, but products are charged at the price displayed at the time you place your order.
- We make every effort to ensure prices are correct. If we discover an obvious pricing error on an item you have ordered, we will contact you to confirm whether you wish to proceed at the correct price or cancel.
## 4. Orders and formation of the contract
- To place an order, add products to your basket and follow the checkout process. Before confirming, you can review and correct your order.
- Placing an order constitutes an offer to buy. The sales contract is formed only when we send you an **order confirmation email**.
- We reserve the right to refuse or cancel any order, for example in cases of suspected fraud, an obvious error, or stock unavailability.
## 5. Payment
- We accept the payment methods shown at checkout (e.g. major debit/credit cards, PayPal, Klarna where available).
- Payment is taken at the time of order. Transactions are processed securely by our payment providers; we do not store your full card details.
- Your order will not be dispatched until payment has been successfully authorised.
## 6. Delivery
- We dispatch orders within 24 hours (business days) and estimated delivery is 6 to 8 business days, as detailed in our **Shipping Policy**, which forms part of these Terms.
- Risk of loss or damage passes to you when you (or a person you nominate) take physical possession of the goods.
## 7. Right of withdrawal and returns
You have a 14-day right to cancel and return your order as set out in our **Refund & Returns Policy**, which forms part of these Terms. Faulty or incorrect items are handled at our cost.
## 8. Legal guarantee of conformity
Beyond any commercial guarantee, products benefit from the legal guarantees applicable to consumers, including the **legal guarantee of conformity** and the guarantee against **hidden defects**. As a UK consumer, you also benefit from the rights under the Consumer Rights Act 2015 (goods must be of satisfactory quality, fit for purpose, and as described). ## 9. Our liability
- We fulfil our obligations with reasonable care and skill. We are responsible for foreseeable loss and damage caused by us where we breach these Terms.
- We are not liable for losses that are not foreseeable, or for delays or failures caused by events beyond our reasonable control (force majeure).
- Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.
## 10. Intellectual property
All content on the Site, including the Novell Home brand, logos, text, and images, is protected. You may not reproduce or use it without our prior written consent.
## 11. Personal data
We process your personal data in accordance with our **Privacy Policy**.
## 12. Complaints and dispute resolution
- For any complaint, contact us first at **support@novell-home.com**; we will do our best to resolve the matter amicably.
- **EU consumers** may use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
- **UK consumers** retain access to alternative dispute resolution and the courts under applicable UK consumer law.
## 13. Governing law
These Terms are governed by **French law**. This does not deprive you, as a consumer, of the protection granted by the mandatory provisions of the law of your country of residence (including, for UK consumers, the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013).
## 14. Changes to these Terms
We may update these Terms from time to time. The version applicable to your order is the one in force on the date you place it.
